MEMBERSHIP LEVELS

STANDARD MEMBERSHIP

If you just want to buy or download products on train2connect, no sign up is necessary! Just search around and find a great program.

SELLER ACCOUNTS

If you’d like to sell your own products on train2connect, there are two types of Seller accounts available. Both offer the ability to digitally post your personal training programs for sale and post personal training programs for free but the two accounts have different payment structures. 

A basic seller account is free, but you will be charged 40% commission for your sales.

 Premium Seller account is $99 per year and you will earn a higher royalty compared to our Basic Seller account

SELLER ACCOUNTS

If you’d like to sell your own products on train2connect, there are two types of Seller accounts available. Both offer the ability to digitally post your personal training programs for sale and post personal training programs for free but the two accounts have different payment structures.

What’s an alias?

If you have a Seller account, you have the option of adding an alias.

 An alias is the public name of your train2connectstore if you choose to not use your own name. Some successful sellers use an alias and some use their own name.

 Your alias will appear when you post comments, for instance.

GENERAL TECHNICAL FAQ

Which browser should I use for train2connect?

To get the most out of train2connectand access all our latest features, you should use a supported browser, and enable cookies and java script.

 In general, that means Chrome, Firefox, Internet Explorer, and Safari. train2connectsupports the current and major prior releases of these four browsers on a rolling basis. Minimum browser requirements are:

  • Chrome: Latest version
  • Firefox: v. 26
  • Internet Explorer: v. 9
  • Safari: v. 5.1

If you are choosing a browser, we recommend Google Chrome. Use these links to download the latest version of each of these browsers (they are all free):

Please note that train2connectis not yet fully optimized to run on tablets.

How do I enable cookies and Javascript on my browser?

Many features on train2connectrequire cookies and JavaScript to work properly. Many browsers will have these enabled automatically, but if we detect that they’re not, we’ll display a message on the site.

You can visit this link to see if your browser is JavaScript enabled. If it’s not, that same page will give you instructions on how to enable JavaScript in your browser.

What if I can’t download a file?

Most of the time, downloading problems are temporary—your Internet connection flickers or your browser stalls, so your download is interrupted. Refresh your browser and try again in a few minutes.

 Remember that some public WiFi restrict downloading. If that’s the case, you’ll need to download your file at home instead.

If you’re still having other problems with your download, contact us for assistance.

What if I can’t open a file?

First things first: Make sure the file you want to open has downloaded completely. Large files vary in how long they take to download, depending on the size of the file and the speed of your Internet connection.

Also, some public WiFi have downloading restrictions. You should have no problem downloading the file on your home computer.

If nothing’s working, it’s possible that the file is corrupted. In that case, the seller will need to re-upload the personal training program. Please contact the seller to alert him or her of the problem.

In any case, please do us—and the seller—a favor and avoid leaving negative ratings or comments for a seller if a file won’t open. Most of the time, this isn’t the seller’s fault and the problem can be resolved.

What if my file isn’t printing correctly?

Sometimes a PDF will look fine on your screen, but may not print out correctly (especially if the file has a lot of graphics).

 Try this:

  1. Open the file in Adobe Reader.
  2. Click “Print” within the Adobe Reader application.
  3. Select “adjust to fit” if necessary.
  4. Click “advanced” to bring up the advanced print settings menu.
  5. Choose “print as image” and then click “OK” to save that setting.

Now try printing again.

Why is my PDF blurry?

Are you seeing black lines where the images should be?

It’s probably one of two issues.

  1. You don’t have the latest version of Adobe Reader. Download it for free here:http://get.adobe.com/reader/otherversions/(Mac or PC). Once you download and install it, try opening the PDF again.
  2. You’re on a Mac and your default PDF viewer isn’t Adobe Reader. Other viewers, like Preview, may not work with newer PDF files. Follow these steps to open your PDF in Adobe Reader:

Make sure you have the latest version of Adobe Reader installed (see #1, above).

Highlight the PDF you want to open.

Go to “File” at the top of your screen.

Choose “Open with.”

Select “Adobe Reader.”

You may be prompted to make Adobe Reader the default program for opening PDFs. It’s a good idea to say yes. Then you won’t have to repeat the “open with…” process for every PDF.

How do I open a PDF with Adobe Reader on a Mac?

The default PDF application on a Mac is called Preview. This program is not compatible with newer PDF files. So Adobe Reader works better. Here’s the trick: Don’t try to open the PDF file by clicking on it.

Instead, launch Adobe Reader. Then go to the File menu, select Open, and choose the PDF you want.

You may be prompted to make Adobe the default program when opening PDFs. If you agree to this option, then in the future you should be able to open PDFs by clicking on them.

Be sure that you have the latest Adobe Reader software installed on your computer.

How can I troubleshoot my train2connectexperience?

We’re sorry things aren’t going smoothly! Here are some common issues, and fixes to go with them.

  1. train2connectis not yet optimized for use on tablets. So if you’re trying to browse, buy, or upload from a tablet, try using a laptop or desktop for now.
  2. Could your browser be out of date? Update your browser of choice to the latest version. If that doesn’t help, try using train2connectvia a different browser. train2connectsupports Safari, Chrome, Firefox, and Internet Explorer.
  3. Are javascript and cookies enabled on your browser? Many features on train2connectrequire them.

What is a PDF file?

A PDF file is a commonly used graphic file.

 PDFs are best viewed with Adobe Reader (but there are other programs that can read PDFs). If you would like to download Adobe Reader for free, click here.

 Please note that in most cases, you can’t edit a PDF.

How do I find free personal training programs?

Use the train2connectbrowse navigation to narrow down your search and then filter by “FREE.” You’ll find a treasure trove of quality, trainer-tested programs.

But remember, most priced content is quite affordable, and you help other trainers when you buy.

What are train2connect’s Seller Guidelines?

When selling personal training programs on train2connect, keep in mind the following rules to help guide you along the way:

train2connectis a place where trainers share, buy, and sell personal training programs that support learning, developing skills, or the process of creating personal training programs for clients.

 train2connect is an honest and transparent marketplace

The train2connect community is built upon trust. Trainers selling on train2connectshould only offer personal training programs that they have produced or designed themselves. Resources should be free of technical issues, complete, and ready to be used upon download. Additionally, Sellers shouldn’t incentivize or otherwise artificially game ratings and feedback.

train2connectis a respectful community of trainers

Engaging with other trainers and the broader community is an important part of the train2connectseller experience. Treat each other with respect and care, respond to feedback and questions with an open mind, and help keep train2connect one of the best communities on the Internet.

MY ACCOUNT

When I upgrade to “Premium Seller,” when does my year subscription begin?

Your Premium Seller subscription begins on the same day that you upgrade to that account. 

 You earn the premium royalty rate on all sales that occur from the day that you upgrade through the next 12 months. Premium royalties are not applied retroactively.

I live outside of the U.S. Can I sell on train2connect?

Yes! train2connectis an international open marketplace and we have many sellers in Canada, Australia, and the U.K.

 If you live in another country, you are welcome to sell if PayPal operates in your country. We use PayPal to deliver sellers’ monthly earnings. Visit http://www.paypal.com/ to see if your country is included in their network.

Also keep in mind that train2connect buyers are English speakers. All content is in English.

Can I sell subscriptions to my website on train2connect?

MY PRODUCTS

I have a question about copyright. Can you help?

We can’t give advice about specific copyright questions.

However, we do have a copyright page, which you can read through to gain insights into this important subject! It contains lots of useful info, so be sure to check it out.

A product on train2connect violates my copyright. What should I do?

For copyright violation claims, please follow the instructions outlined on our copyright policy page.

You’ll want to be sure to include all of the required pieces of information listed in the instructions. If your notice contains all of the appropriate information, then we will promptly remove or disable access to the infringing material.

Also note that the same page includes information on what to do if any of your products are removed due to an alleged copyright infringement.

Can I post the same personal training program with a different title? Can I post the same personal training program to multiple stores?

No. To help avoid Buyer confusion, please don’t post the same personal training program more than once. If there are substantive differences that truly change the nature of the personal training program, feel free to post as a separate personal training program and clearly outline the differences in your personal training program description.

If it’s brought to our attention that a Seller has been posting duplicate personal training programs, we’ll reach out and ask that Seller to remove them.

My personal training program can be used by multiple ability levels. Can I post it twice?

If your personal training program can be used by multiple grade levels, designate that clearly in the product description and tag multiple grade levels. To help avoid Buyer confusion, please don’t post the same personal training program in your store more than once.

If there are substantive differences that make the personal training program truly aligned to a different audience, please post it as two separate personal training programs and clearly outline the differences in your personal training program description.

I worked on a personal training program with a friend. Can we both post the personal training program to our stores?

To help avoid Buyer confusion, personal training programs should be posted in a single store only. If you’ve worked on a personal training program in collaboration with another Seller, please post the personal training program in only one of your stores.

Can train2connect remove a comment or rating left by a buyer?

Feedback can cause confusion and consternation for sellers sometimes. train2connect is an open marketplace where buyers are encouraged to leave feedback that they feel is appropriate to the product they have purchased.

train2connect can delete comments that are:

  • Based on technical issues on the buyer’s end (downloading, software issues etc.)
  • Abusive or contain inappropriate language
  • Spam (saying the same exact thing to all sellers without thinking; or advertising anything)

 If the comment does not meet one of those criteria, we will have to let it stand.

 Thank you for understanding and for participating in train2connect’s open marketplace.

How do I promote a product on the site?

train2connect allows you to promote your products outside of your store through our advertising program. It places your items in high-profile, high-traffic locations on our site. You can feature your products at the top of every page in a category for 24 hours. Email us for more info!

Where can I find clip art to use in my products?

If you want to include clip art in a personal training program you’re selling on train2connect, you’ll need to purchase the artwork with a license for commercial re-use. Or you can find vendors who make their art available royalty-free.

Be sure not to include any art, photos, or other images in your products if you aren’t sure that you have the right to use them. That includes images found on the web.

MY STORE

Help! Someone’s taken my store name!

If you feel like someone is impersonating your store name or brand, please contact us. In cases where one Seller has a clear claim to an already established brand, we’ll reach out to the newer Seller and request a name change. If we’re unable to identify a clear claim, however, we’ll have to rely on Sellers to resolve the situation.

Can I contact my Buyers outside of train2connect?

Protecting our members’ privacy is serious business. That’s why we don’t give out your personal information (email, phone number, address) to Buyers who purchase your personal training programs or anyone else.

We respect your privacy, and expect all to do the same. Sending unsolicited communications outside of train2connectto other members of the community (by email, phone, or otherwise) is against train2connect’s policies.

 Want to contact a Buyer to address an issue with a personal training program or to offer a refund? Contact us and our support team can reach out on your behalf.

Can I access email addresses for my buyers?

To ensure our buyers’ privacy, we don’t make their email addresses accessible through train2connect If a buyer contacts you with a question or comment, you will be able to reply through train2connect.

TAX QUESTIONS

When will I get my 1099-K?

The train2connectAccounting team works hard to get 1099-K documents processed and issued as quickly as possible, but no later than February 1. Your 1099-K will be delivered by email to the address associated with your train2connectaccount.

If February 1 rolls around and you’re not seeing your 1099-K in your inbox, be sure to check your junk or spam folder to see if it filtered there by mistake. 

If you’re still not seeing it, feel free to reach out to us via email and use the subject line: 1099-K. 

Do I need to submit a W-9?

You’ll receive an email from us with an explanation and instructions on how to submit a W-9 if we need one from you.

We don’t have to collect a W-9 from everyone. To comply with IRS regulations, train2connectcollects this information and issues 1099-K forms to train2connect programmers who have had sales of more than $20,000 this year. If that’s you, you should look out for an email from us. If you’re not in that category, you won’t get these tax documents from us this year.

If you think you’ve crossed this threshold or that you will by the end of the year and you haven’t heard from us, contact us and we’ll double check.

Regardless of whether you get a tax form from us or not, it’s important to understand your tax reporting needs, and while train2connectcan’t provide any tax advice, we strongly recommend that all of our Trainer-Authors talk to tax professionals to better understand how to report their taxes.

What happens if I don’t make $20,000 on train2connectthis year?

You will only receive a 1099-K if you cross the $20,000 in gross sales threshold. Providing W-9 information does not mean you will receive a 1099-K.

Regardless of whether you make $20,000 on train2connectand receive a 1099-K, you should consult your tax advisor on how to report your train2connectsales.

Why is train2connectreporting gross sales rather than earnings?

The IRS requires that we report your gross sales for the calendar year on your 1099-K form.

Keep in mind though, that the amount train2connectreports on your 1099-K may not be the same as your taxable income. You may be able to deduct certain expenses against your gross sales when you fill out your tax forms.

 As always, train2connectcan’t provide any tax advice, and we strongly recommend all of our Sellers talk to tax professionals to better understand how to report your taxes to the IRS based on your own tax situation.

Where can I find my Tax ID number required on the W-9 form?

For individuals, use your social security number.

 For other entities (that means if you’ve incorporated or created a business that is recognized by the IRS), use your employer identification number. That’s a nine-digit number assigned to you by the IRS. You’ll find that number in your business formation documents or you can check a prior year tax forms

What if I became an LLC or corporation during the year?

We have to issue 1099-K forms for every train2connectStore that has had sales of $20,000 or more in the year. If that’s you, you’ll get a 1099-K regardless of what type of business entity you are. 

If your train2connectStore became a different business type during the year (LLC, S Corporation, C Corporation) let us know. We’ll need the following from you:

  • A W-9 filled out with the business entity or individual information from the first part of the year
  • A W-9 form filled out with your new business entity’s information
  • The date that your new business entity went into effect (filing date)

What we’ll do with this information is to issue you two 1099-K forms splitting your annual sales by the date that you changed your business. 

What is the difference between gross sales and earnings?

Gross sales is the dollar amount of sales you’ve made on train2connectin a calendar year. This is the number you start with before you subtract any expenses.

train2connectearnings is your gross sales minus certain expenses (such as train2connectcommissions). This distinction is important because the IRS requires that we report your gross sales on your 1099-K form.

If my business is incorporated as an S-corp or a C-corp, will I receive a 1099-K?

Yes. As long as you reach the $20,000 gross sales threshold for the year and you submit accurate W-9 information to train2connect, you will receive a 1099-K as an incorporated business. 

What’s the deal with sales tax?

Does train2connectcollect sales tax?

train2connectdoesn’t collect sales tax on purchases from the site, but we’re working on a solution to make it easier for you to charge and collect sales tax on your sales.

Am I responsible for sales tax?

It depends. Sales tax reporting requirements vary quite a bit from state-to-state and even by locality. And some states have no sales tax at all (let’s all move there!). train2connectisn’t allowed to give advice or get specific about your situation, so we encourage you to talk to your tax advisor about your sales tax needs.

What if I don’t have the information I need to report?

If you discover that there’s more information you need from us to satisfy the sales tax requirements of your locality, state, or country, we’re happy to do what we can to help Contact Us with more details and someone from our Support Team will get back to you.

MY PURCHASES

What should I post in the comments section?

Comments are a great way to give Sellers feedback about the personal training programs they share. Feel free to offer words of encouragement, share stories from the gym, or offer honest and constructive criticism about the personal training program. Buyers should not post technical questions, abusive comments, or spam (advertisements or requests to follow). Comments that break these rules will be deleted, and action may be taken against those users.

Can I get a refund for personal training programs purchased on train2connect?

At train2connect,the vast majority of personal training programs you purchase are delivered electronically. Unlike a t-shirt or a book, you can’t (really) return a PDF, Word Document, or other file after it’s been downloaded. For that reason, all sales on train2connectof digital personal training programs are considered final and nonrefundable.

We get though that things don’t always go as planned and so we can offer refunds in a few limited circumstances. If you’ve never downloaded the personal training program or if your purchase falls into one of the following exceptions listed below, you may be eligible for a refund. 

  • Compromised Resource File—the personal training program file is damaged or is missing content.
  • Misrepresentation—the personal training program preview and/or description misrepresents what is contained in the personal training program. (All requests are subject to train2connectE C T review)
  • Technical Limitations—you’re unable to access a personal training program because the technical requirements aren’t included in the personal training program description.
  • Duplicate Purchase—you accidentally purchased the same personal training program twice.
  • File Replacement—a Seller accidentally uploads the wrong file and doesn’t replace it in a timely manner.

Refund requests must be submitted within 1 month and are granted on a case-by-case basis.

If your purchase falls into one of these categories, you can submit a refund request. Please be sure to include in your request: the personal training program name and your concerns, along with any specific examples or details you might have. Screenshots welcome!

When and how do I get paid?

The when: train2connectpays sellers’ earnings monthly. If you choose to take part in Member Sponsored promotional programs (this is totally optional), we deduct advertising expenses from your payout automatically. Usually, you’ll receive your payment within 21 days from the end of each month.

 The how: By default, payments are made via PayPal.

If you earn more than $10,000 in a month (it happens!), which is the maximum we can send via PayPal at one time, we will send you multiple payments.

What fees are associated with Payouts?

PayPal payouts incur a fee of 2%, up to a maximum of $1.00, for all sellers: American, Canadian, and international. For example,

  • If you earn $10 in a month, the payout fee will be 20 cents
  • If you earn $25 in a month, the payout fee will be 50 cents
  • If you earn $50 in a month, the payout fee will be $1.00
  • If you earn $100 in a month, the payout fee will be $1.00

More than one person runs our train2connect store. Can you split our earnings and pay us separately?

We very much prefer to pay one PayPal account, so if you can share on your end, we’d really appreciate it. 

We recommend that you incorporate and set up a new PayPal account for your small business, then pay yourselves from that account.

You sent my earnings to PayPal, but I don’t see the money in my account. What do I do?

You may need to finish setting up your account the first time that money is sent to you via PayPal. In the email notification from PayPal about the payout, there are instructions on how to complete setting up your account, how to verify it, and/or how to accept your first payment. 

 Please follow those instructions fully within 30 days of getting the notification or PayPal will send your money back to us. 

 If 30 days have pass, simply email us and we will send your payment again.

 Once you set up your account and accept your first payment, subsequent payments will be delivered to your PayPal account automatically.

What if I have an issue with PayPal?

Occasionally, payments are “denied” by PayPal. This can happen if there is a fraud alert or another issue with your PayPal account. 

There is little we can do here as it’s between you and PayPal to solve. In this case, it is necessary for you to call PayPal’s Customer Service department at 888-221-1161 to sort out the issue. Once you do so, if your payment is still not appearing simply email us and ask us to resend your payment.

I was paid for the most recent month’s earnings, but you still owe me for previous months’ sales. What do I do?

Good news! If you have just recently added your PayPal info to the “My Account” page, you are now getting paid. But yes, we may owe you previous months’ earnings if there was no payment info on record for you. 

Email us and let us know, and we will get you paid and up-to-date within a few days.

How can I report infringement of my work to train2connect?

train2connect respects the intellectual property rights of others and expects the same from all of our members. We comply with the laws governing the use of intellectual property, and will take action against accounts who violate our policies.

If you believe that content posted on our site infringes on your copyright or trademark, you can submit a notice to our copyright department at info@train2connect.com.  

 If you submit a notice, please be sure to read our policy and include all of the required pieces of information. If you’re not sure whether or not the personal training program you’ve found is infringing on your work you may want to consult an attorney before you submit a notice.  

When we receive a completed notice with all of the required information, we work hard to process it quickly and remove the identified content.

SELLER QUESTIONS

Can I use images I found on the internet in my personal training programs?

It depends.

When you’re looking for images to include in your personal training program, it’s tempting to turn to Google images. Don’t do it. Just because you can access an image for free doesn’t mean you’re free to reuse it in your train2connect personal training programs. It’s important to know whether the person who owns that image allows folks to use it, and what uses they allow.

The key is to make sure that you have the right to use anything you include in your personal training programs. That includes photographs, clip art and other images, borders and other design elements, and so on.

As always, your safest bet is always to use only things you’ve created yourself, but we know that’s not practical for everyone. We can’t all be clip artists and font designers as well as amazing trainers and programmers.

 There are many websites of image and clip art libraries. It can be tough to know which sites to trust, and how to navigate their licensing rules, so it’s good to be cautious and read carefully. We’ve done some research for you and found a few sites you might want to check out.

Subsciption-Based/Pay-Per-Image:

I’ve heard a lot about Fair Use, but I’m not sure how it applies to my work. What is it?

Fair use is an exception built into copyright law which allows creators to use the copyrighted work of another without their permission. This is a very tricky exception because what you consider fair use may not be what the original copyright owner considers to be fair. The ultimate judge of what is fair is an actual judge in a court of law where these cases get settled. Decisions tend to depend on the facts of each case, so as a creator it’s hard to look to these cases for lessons you can apply to your own use of another’s content. For this reason, we highly recommend using only your own original work in your personal training programs or getting the written permission of another creator before using their work in your own.

 Is it ok to include hyperlinks or QR codes to other websites in my personal training programs?

One of the key principles behind copyright is ownership and allowing an original creator to maintain control over where and how their work is displayed, distributed, reproduced, and so on. Linking to content through a hyperlink or QR code to send the user directly to the source rather than copying and pasting that content into your personal training program tends to be a much safer option.

That being said, the law on this issue is pretty murky, and some website owners have adopted what’s called “no link” policies. So, it’s good practice to be aware of whether the site you want to link to has any restrictions like this, or ask for permission to link to the content you’re interested in.

How can I know if something I want to include as part of my personal training program is copyrighted?

Remember that copyright protection is automatic. So, in general it’s safe to assume that someone owns and has copyrights to the content, and you should be really careful before you include any content in your train2connectpersonal training programs that you didn’t create yourself. The major exception to this principal is work that has aged out of copyright protection and is in the “public domain.”

What does public domain mean, and how do I know if something is in the public domain?

When a piece of work is in the public domain, that means that no one owns the copyright to it anymore any anyone is free to use it. Great, right? So how to do you know whether a work is in the public domain? That’s the trickier part. The most common way that work falls into the public domain is by aging out of its copyright protection. The law sets a time limit on how long work can be protected by copyright. But those rules have also shifted over time, so it can be hard to know for sure. I’m a new train2connectprogrammer and want to make sure my store name is unique. Do you have any tips for selecting one?

We do! The key to selecting a unique store name is research. Your store name is the foundation of your brand. It’s what will set you apart in the Community and it’s how your Buyers will recognize you. That’s why, if you want to stand out, you should know which names are already out there. If you select a name that’s the same or too similar to one that already exists, you risk stepping on the toes of a Seller who’s come before you. You may also confuse Buyers about who they’re buying from which isn’t how you want to kick off your business.

There’s also a legal component to selecting your store name. Some names or phrases may be trademarked, meaning that another Seller has the exclusive right to use that name or phrase. Doing your research upfront will help you to avoid any conflicts down the road.

 So where to begin? Whether you’ve already thought of the perfect name or you’re looking for inspiration, start your search on train2connect. Use your judgment to gauge two things: whether the name you’re hoping to use 1) represents who you are as a business and 2) is truly original and won’t interfere with another Seller’s store name. After you’ve found an option that could work, we recommend you widen the scope of your research to a general online search. How do I obtain a copyright in my work? Should I register my copyright?

Here’s the good news: once you’ve completed your creative, original work, you don’t need to take any additional steps to own the copyright in your work. This means that the full menu of exclusive rights you have in your work kick in automatically!

 The advantage of registering your copyright is that registration gives you additional protections. If you believe someone has infringed on your work and you decide to bring a lawsuit against them, you must have registered your copyright to do so. By registering your copyright, you also increase the likelihood that a court would find your copyright claims to be legitimate. And if you win, you’d be eligible for a greater number of legal remedies.

Why was my personal training program taken down while similar personal training programs by other programmers are still up?

If your personal training program has been removed because of a copyright or trademark complaint, you might find other personal training programs like yours that haven’t been taken down. We understand that’s confusing and may feel unfair, so we wanted to give some context.

 As the host of a marketplace, train2connectfollows the legal process outlined in the Digital Millennium Copyright Act (DMCA). When a copyright or trademark owner sends us a notice claiming infringement, they have to identify the content by listing specific URLs of the train2connectpersonal training programs they claim are infringing.

To comply with the law, we remove only the personal training programs listed in the notice. So if a personal training program hasn’t been removed, that means the copyright or trademark owner probably didn’t identify that personal training program as infringing and didn’t include it in their notice. train2connectdoesn’t have much discretion in these situations, and we aren’t able to make judgment calls on behalf of copyright owners.

A good rule of thumb is to double check your local rules, your gym or district’s intellectual property or copyright policy, and your employment agreement for what rights you might have to the personal training programs you’ve created.

I found my personal training program posted on another website. Can train2connect do anything?

We expect all train2connecttrainers to follow our rules and respect the intellectual property rights of train2connect programmers. That includes not uploading train2connect purchases to the internet.

Unfortunately, we can’t know what goes on outside our site, and there isn’t much train2connectcan do when this happens. If someone reports it to us, we’ll reach out to let you know and forward that information along. Because it’s your intellectual property, we want to make sure you’re aware so you can address it. But we’re not able to take action on your behalf. Only the copyright owner can identify unauthorized use of their work and ask for it to be removed.

Do I have to worry about my title? How can I make sure it’s ok?

As with the content of your personal training program, the safest approach when titling your personal training programs is to come up with your own unique title.

 The most common issue with titles has to do with trademark rights. While titles can’t be copyrighted, they can be trademarked if they’re unique enough. For example, you couldn’t title your next book, “Harry Potter And The Sorcerer’s Stone” which has been trademarked.

 You can also run into trademark trouble if you use a brand name or other trademarked term in your title. Whenever you’re associating your work with a trademarked name, you have to be super careful not to make it sound like your product is made or endorsed by that brand or company. The safest option is to not use any trademarked terms or names as part of your title.

If you are going to use a trademarked term or name in your title, there’s no guarantee you’ll be safe. But, it’s typically safer to indicate clearly in your title that your personal training program is “for use with”, “made for” or “compatible with” the other product. For example, listing my homemade laptop case as “Laptop case made for use with Apple laptops” would be safer than “Apple Laptop Case”. Why? The second example could lead some folks to believe that the laptop case is an Apple product associated with, endorsed, or made by Apple while the first example indicates only that the case is compatible with Apple products.

If I create a personal training program with a colleague who owns the copyright?

It depends. More than one person can have copyrights in a piece of work. Whenever you’re collaborating with others to create materials, it’s important to talk about and agree in advance on whether the whole product will be jointly owned, whether separate contributions will be separately owned, or whether you’ll have some other arrangement. You may want to consult a legal advisor for assistance.
